1. What you are buying

A subscription gives you a regular list of pending applications and recent planning approvals published by the local planning authorities named in your subscription, filtered to the trade category you selected. Lists are sent by email with a CSV attachment, usually on Monday mornings. A 07:00 daily schedule is an optional paid upgrade available only where we confirm that the council feed supports it.

We compile the lists from councils' public planning registers and may add non-monetary project-type tags derived from the published description. We do not supply applicant names, personal contact details or guessed project values. We do not generate enquiries, introduce customers or guarantee that anyone on a list wants work done.

Pending and approved records are collected as separate stages and clearly labelled. This is a rolling data service, not a real-time alert, and a council is offered only after both stages have been checked.

2. Your patch

Shared Local covers one named council and one trade category. Shared Area covers up to four named councils for one trade category. Shared Region covers up to ten named councils for one trade category. Exclusive Patch covers one named council and one trade category. Each council-and-trade combination remains a separate patch for availability and delivery purposes.

You may request any UK council, but submitting an availability request does not mean that its feed is operational and does not reserve or secure a patch. A patch is allocated only when we confirm data quality and availability in writing and the subscription begins.

3. Exclusivity

Exclusivity applies only to an Exclusive Patch. After we confirm it in writing, and while it remains active and paid, we will not supply another Exclusive Patch for the same council-and-trade combination. Shared plans may be supplied to more than one business and do not carry exclusivity.

Exclusivity applies to the combination of council and trade category. It does not prevent us supplying the same council's list to a business in a different trade category, or supplying your trade category in a different council. It does not restrict what any other data provider does, and it does not stop anyone consulting the council's public register directly — that register is public and we have no control over it.

Your patch is released, and may be offered to another business, seven days after your subscription ends or a payment fails and is not resolved.

4. Free sample

Where suitable data are available, prospective subscribers receive one redacted sample list for their council and trade before payment is taken. The sample may withhold full site addresses and direct council-record links; these are included in the paid service. Requesting or receiving a sample does not reserve a patch and creates no obligation on either side.

5. Payment and tax

Subscriptions are monthly in advance using the payment method shown at checkout and continue until cancelled. Shared Local is £9 per month, Shared Area is £19 per month and Shared Region is £39 per month. Standard Exclusive Patch pricing is £79 per month. The first ten customers whose Exclusive Patch payment completes successfully receive that plan for £44 per month for their first three billing months, then £79 per month. An enquiry or unpaid checkout does not secure an introductory place. Optional daily delivery is £20 per month where available. We will remind introductory customers before the standard rate starts. Any other price change gets at least 30 days' notice.

We email a numbered invoice after each successful payment. The Patch List is not registered for Jersey GST, so no Jersey GST is charged. Where this service is supplied to a UK business under the general business-to-business place-of-supply rule, we do not charge UK VAT. The UK business customer must account for UK VAT under the reverse charge in section 8 of the Value Added Tax Act 1994, where applicable.

You must give us accurate legal-name, business-address and tax details, confirm that the subscription is for business use, and tell us if those details change. You are responsible for your own VAT position, including any registration consequence of receiving services from outside the UK.

6. Cancelling

You can cancel at any time by emailing us. Cancellation takes effect at the end of the month you have paid for; we do not pro-rate part months. We may cancel your subscription on 30 days' notice, or immediately if you breach clause 7, and will refund any period paid for but not delivered.

7. How you may use the lists

The lists are licensed to you, not sold. You may use them for your own marketing about your own services. You may not:

Your first postal communication to an address from a list must clearly state that the address and planning information came from The Patch List, include the URL thepatchlist.com/privacy, and explain that the recipient can object by emailing optout@thepatchlist.com. You must also provide your own identity and privacy information as required by law.

You are responsible for your own marketing and for complying with data-protection and marketing law. The lists are licensed for postal marketing only. They do not include permission for email, telephone, text message or automated marketing. If we tell you an address has opted out, you must stop contacting it and delete it from your active records.

Breach of this clause ends your subscription immediately, without refund.

8. Accuracy

The information comes from councils' own public registers and we pass it on as published. We check our filtering but we cannot verify the underlying records, and councils make mistakes, redact records and change decisions. We do not warrant that a list is complete, current or accurate, and you should check the council's record — we link to it on every row — before acting on anything.

9. Liability

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. Subject to that, we are not liable for lost profits, lost business, lost opportunities or wasted expenditure, and our total liability to you in any twelve-month period is limited to the subscription fees you paid us in that period.

10. Data protection

Each of us is an independent controller of the personal data we hold. How we handle it is set out in our privacy notice. When you receive a list you become a controller of that information and take on your own obligations under the law that applies to you, including any required registration. The Patch List is registered with the UK Information Commissioner's Office under ZC234544 and the Jersey Office of the Information Commissioner under 104080.

11. General

We may change these terms on 30 days' notice; if you do not accept a change, cancel before it takes effect. If any clause is unenforceable the rest stands. Nothing here creates a partnership or agency between us. A person who is not a party to these terms has no right to enforce them.

These terms are governed by Jersey law and the courts of Jersey have exclusive jurisdiction. Nothing in these terms removes any mandatory legal right or remedy that cannot lawfully be excluded.
